Michael Gish’s point is that it’s not just about losses. You have to take all the labor cost and commissions into account, plus title insurers don’t get the high level of leverage to juice their ROE’s as P&C or life insurers do. For example, Stewart Information Services only had a 2% ROE for 2011 despite a very low loss ratio. I don’t dispute that the need for title insurance seem questionable, but Gish had some valid points.

I bought into Beringer Harvard I reit about 7 years ago. I had an excellent return until the downturn in 2008 and my monthly check went from $1500 per month to $200 a month. The share value went from $10 to $4.50. They told me not to expect any recovery for 5 years. Two years ago I read that commercial property was turning around so I was pretty excited until The reit told me a couple of months ago that the value dropped almost another .50. How do you figure that? I called them and they gave me some cock and bull story. I made the mistake of listening to my financial adviser who highly recommended the reit. We, as investors don’t need the snide remarks I’m reading here. Not everyone is an expert on investing. I no longer have that investment advisor.

Chicago title burned me a few years back. The seller paid for a policy that was supposed to protect me against liens. The title was supposed to be clean but a few months after purchasing I get a bill from the water company. The past seller had not paid the water bill in a long time and there were fines associated with the late payments that they were trying to collect from me. They threatened more fines if I didn’t pay. I paid the amount since it was small but then tried to collect it from Chicago Title. They admitted that the mistake was there’s because they didn’t check all the fines were paid on the date of sale but rather a few weeks too early. They asked for documentation which I provided but then they proceeded to ignore my phone calls and emails. It was a small enough amount that I didn’t bother fighting over (under $100) but still it seems like as Seth and others here are saying, you pay for title insurance but you don’t really get protection. I wonder if there is anyone out there that has personally felt that they really got their money’s worth.

“It’s the whopping $1.9 billion in commissions paid to agents who drum up business.” This refers to title agencies (not real estate agents, if that is what is implied)which are a very large part of the title industry. In fact, Entitle Direct uses and pays title agents.

Title agents realize the majority of the title revenues collected in transactions for the work they do, then remit a percentage to the insuring companies to cover premium taxes, reserves for losses, etc. These are not kickbacks; accounting standards require them to be listed as they are on the insurer’s balance sheet, but as opposed to the commissions the author clearly believes they are, those dollars are revenue for all the work performed by title agents.

I had the (Mis)fortune of working on Parsky’s ranch in 1998. I was injured while working on the ranch.
Just as a precaution, I put a voice activated tape recorder in my pocket when I went to work the next day to report my injury again.
